What Fidato is and is not

Fidato (“Fidato,” “we,” “us,” or “our”) operates this website as an insurance comparison and lead generation service. These Terms of Use govern your access to and use of this website and the quote request form on it.

Fidato is not an insurance company, agency, or broker. We are not licensed to sell insurance. We do not:

• Issue policies, bind coverage, or accept premium payments;
• Make underwriting, eligibility, pricing, or claims decisions;
• Provide insurance advice or recommend a specific policy or carrier;
• Act as your agent or fiduciary.

What we do is collect the quote request you submit and transmit it to licensed insurance agencies and marketing partners who may contact you. Any policy you ultimately purchase is a contract between you and the carrier, arranged through a licensed agency — not through Fidato. This site is an advertisement.

Eligibility

You must be at least 18 years old and a resident of the United States to use this site or submit a quote request. By submitting the form, you represent that you meet these requirements and that the information you provide is your own, is accurate, and that you are the subscriber or customary user of the phone number you enter.

Your submission and consent

When you submit the quote form, you provide your prior express written consent for Fidato and the licensed insurance agencies and marketing partners we share your request with to contact you at the phone number and email address you provided about insurance quotes and related services. This includes contact by telephone call (including calls made using an automatic telephone dialing system, prerecorded, or artificial voice), text message (SMS/MMS), and email, even if your number appears on a federal, state, or internal Do Not Call list.

Consent is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply. You may revoke consent at any time — reply STOP to any text, tell an agent on a call, or call (877) 498-3632. See our Privacy Policy for details on revocation and how your information is shared.

You acknowledge that more than one agency may receive your request and contact you, and that this is the intended function of the service.

No guarantee of coverage or pricing

Any rates, savings figures, coverage descriptions, or timeframes shown on this site are illustrative and are not offers, binders, or guarantees. Actual availability, eligibility, premiums, discounts, and terms are determined solely by the insurance carrier based on underwriting and applicable law, and are confirmed only in a written policy issued by the carrier. Not all applicants qualify. Savings vary by individual circumstances, and many applicants will not save. Submitting a request does not create coverage of any kind, and you remain responsible for maintaining any existing coverage until a new policy is issued in writing.

Partner agencies and marketing partners

The agencies and marketing partners who receive your request are independent third parties. They are not owned by, controlled by, employed by, or agents of Fidato. Fidato does not supervise their sales practices, verify their licensing on your behalf, endorse their products, or guarantee their conduct.

Fidato is not responsible or liable for the acts, omissions, statements, contact practices, data practices, or products of any partner, or for any policy or quote a partner presents to you. Any dispute you have with a partner or a carrier is between you and that party. If a partner contacts you and you want it to stop, tell that partner directly — they are independently obligated to honor your request.

Carrier and brand names appearing on this site are the property of their owners and are shown for identification only. Their appearance does not imply affiliation with, endorsement by, or sponsorship of Fidato.

Accuracy of information

We work to keep this site current, but we do not warrant that its content is complete, accurate, or up to date, and we may change it at any time without notice. You are responsible for the accuracy of the information you submit. Submitting inaccurate information may result in quotes that do not reflect what a carrier would actually offer you.

Acceptable use

You agree not to:

• Submit false, misleading, or third-party information, or a phone number you are not authorized to provide;
• Use bots, scripts, scrapers, or automated means to access or submit to this site;
• Interfere with, probe, or attempt to gain unauthorized access to this site or its systems;
• Use this site for any unlawful purpose or in violation of these terms.

We may refuse, suspend, or discard any submission at our discretion.

Telephone calls

Calls to or from the number on this site may be recorded or monitored for quality, training, and compliance. By calling, you consent to that recording. Standard carrier charges may apply to your call. The number displayed may be a tracking number that routes to a licensed agency or call center.

Intellectual property

All content, logos, design, and code on this site are owned by Fidato or its licensors and are protected by intellectual property laws. You may not copy, reproduce, republish, frame, or reuse them without our prior written permission.

Disclaimer of warranties

This site and the service are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, that any partner will contact you, or that you will receive any quote or coverage.

Limitation of liability

To the fullest extent permitted by law, Fidato and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to your use of this site, your submission, or any contact, quote, policy, or conduct of any partner or carrier — whether based in contract, tort, statute, or otherwise, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to this site or the service will not exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Fidato and its officers, members, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of this site, your violation of these terms, or your submission of information you were not authorized to provide.

Disputes and arbitration

Any dispute, claim, or controversy arising out of or relating to this site, these terms, or your submission — including its formation, interpretation, breach, or termination — will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in [COUNTY, STATE] or, at your election, by telephone, video, or on the basis of written submissions. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Fidato agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this class action waiver is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section will remain in force.

Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

Opt out. You may reject this arbitration agreement by writing to us at the address below within 30 days of your first use of this site, stating your name, the phone number you submitted, and that you opt out of arbitration. Opting out will not affect any other part of these terms.

Governing law

These terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws principles. Subject to the arbitration section above, you and Fidato consent to the exclusive jurisdiction and venue of the state and federal courts located in [COUNTY, STATE].

Changes to these terms

We may revise these terms at any time. Changes take effect when posted on this page with a revised “Last updated” date. Your continued use of the site after changes are posted constitutes acceptance of the revised terms. If you do not agree, stop using the site.

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and Fidato regarding this site.
